RENTAL AGREEMENT
Casa
Moderna / Casa Rustika
This agreement is
for rental of the vacation home
"Casa Moderna or Casa Rustika" located
at: Calle Internacional, TODOS SANTOS,
Baja California, Mexico, between "Owner" and
"Guest".
NUMBER
OF GUESTS
Bookings
are based on a maximum of 5 adults or 4 adults
and 2 small children. Each additional
person is an additional $100 per night and
requires prior approval of the property
owners. Guests shall not have more
occupants than stated in this
agreement unless written consent is
obtained from owner.
SECURITY DEPOSIT
Your security deposit
will be returned within 7 days of your
departure providing there are no additional
cleaning charges, no additional hours for use of
property management services (outside of initial
house welcome and house only related
emergencies), house/property damage or theft. We
ask that you leave the home reasonably neat and
clean to secure your full refund.
Spills
need to be cleaned up. We do not require you to
make up the beds, mop/sweep/vacuum the
floors, clean or disinfect the bathrooms and
sinks. You may be charged extra for any
excessive cleaning or damage that is done to the
house or grounds.
NO
PETS ARE ALLOWED
PROPERTY
MANAGEMENT
A
property manager is available to our guests
needs in relation to the functionality of the
house only.
VERY IMPORTANT: guests
must give the property manager a specific time
to meet you at least one week in advance of your
arrival. Please be respectful of her time
by calling ahead if you are running late or your
flight is delayed.
Guests that do not give at least a one hour
notice of being late will be billed at a rate of
$25 per hour, which will be deducted from the
guest's security deposit.
SMOKING
IS PROHIBITED IN THE HOUSE
When smoking
outside the House, the remainder of the
cigarette must be placed in cigarette
container outside.
MAINTENANCE
& ACCESS
Owner
shall make every reasonable effort to keep the
House, its systems and appliances in good
working order. However, despite these efforts,
some items may fail from time to time.
Appliances/fixtures/sinks/toilets
are not guaranteed. Owner will
repair faulty appliance/fixture/sink/toilet
upon notice by Guest. No refunds will be issued
due to failure of systems or appliances.
Property
managers are on call at all times in cases of
house emergencies and will do their best to
guarantee the comfort of guests. Owner,
along with its agents are allowed access to the
House and property upon 1 hour notice.
MAID
SERVICE
While
linens and bath towels are included, daily maid
service is not included. However it is available
for an additional fee of $75 per day. Some beach
towels are provided but you may want to bring
some extras.
CANCELLATION
If payment is not
received 30 days prior to your arrival, we
reserve the right to cancel your reservation
and open the dates for others to reserve.
Reservation cancelled at least sixty days
prior date of arrival are fully refundable. For
reservations cancelled less than sixty days
prior arrival, fees will be refunded if your
time slot can be rented to somebody else at the
same rates.
WEATHER
CONDITIONS AND OTHER SITUATIONS
Owner
is not responsible for any weather
conditions, acts of God or nature that
happen during the Guest's stay. No refunds will
be made due to weather conditions or any
other unexpected situations or incidents that
arise prior to your visit or during your stay at
the property.
DAMAGE
IN EXCESS OF SECURITY DEPOSIT
Guest is responsible and liable to Owner
for damages in excess of the security
deposit for any damage or loss by Guest or
member of Guest's party. Guest
shall be responsible for all costs of
litigation and/or collection including
attorney's fees incurred by owner to
collect any unpaid amounts due under
this Agreement.
WAIVER
AND RELEASE OF LIABILITY
1.
I understand and agree that owners,
its agents, staff or employees
are not liable for any loss, damage of
property, injury to me or my guests during
my stay on the premises.
2. I
hereby release, waive, discharge and covenant
not to sue owners, its agents, staff or
employees for any liability, claim and or
cause of action arising out of or related to any
loss, damage or injury, including death
that may be sustained by me or my guests or to
any property belonging to me arising out of
use of the house or property.
3.
The pool is not child proofed and has no
protections. I assume all risks associated
with the use of the pool and will not hold
owners, its agents,
staff or employees liable for any
injury or death that occurs.
4. The
beach is not recommended for swimming due to
riptides and other hazards. I assume all risks
associated with the beach and will not hold
owners, its agents,
staff or employees liable for any
injury or death that occurs on the beach.
5. The release shall
be effective whether the injury is caused by my
negligence, the negligence of owners,
its agents, staff or employees or the
negligence of any third party.
Guest,
along with all members of Guest's party
agrees to comply with the Policies as set
forth in this agreement.
I
certify that I am at least 21 years of age.
I hereby acknowledge that I have read and
accept the terms and conditions of the
rental agreement.
